Protection against rust is something consumers come to expect on an automobile.  When a vehicle is thought to lack this vital component things can get pretty sticky.  In the case of Brian Warner et al. v. Toyota Motor Sales, U.S.A., Inc the plaintiffs allege that Toyota failed to apply adequate rust protection on the frames of certain Tacoma, Tundra, and Sequoia vehicles.  In response, Toyota has denied these allegations stating there has been no wrong doing when it comes to rust protection on the vehicles.  However, both parties have agreed to resolve matters before the issues were decided upon in court.  Those who believe they are eligible to make a claim can begin the filing process by going to the Toyota Frame Settlement page and entering their Claim Identification Number.

I’m slightly interested….what else should I know about the Toyota Frame Settlement?

  • The Settlement Class may include anyone who previously or currently owns or leases a Tacoma from 2005-2010, a Tundra from 2007-2008, or a Sequoia from 2005-2008
  • A Frame Inspection and Replacement Program will be used to determine whether frames should be replaced in accordance with the terms of the Toyota Frame Settlement
  • Those who wish to submit a claim will need to make sure a Claim Form is filed within the Claim Period (January 3rd, 2017 through 60 days after the Fairness Hearing)

Best efforts will be made to pay all accepted Toyota Frame Settlement claims within 90 days (given the claim was filed after the settlement is approved).  Those who think the settlement just plain stinks (for lack of a better term) can opt out by sending an exclusion request prior to the March 27th, 2017 deadline.
