If there’s anything that has been gleaned from previous class action settlements it’s the fact that consumers just DO NOT appreciate when a product begins to rust prematurely. The Plaintiffs in the Oaks vs. Sears Roebuck Co. class action lawsuit apparently share this same sentiment. The suit was originally filed over allegations that Kenmore Grills sold by Sears were manufactured with fireboxes made out of galvanized steel making them defective and prone to rust prematurely. Sears, on the other hand, denies any wrongdoing whatsoever but has agreed to enter into the Kenmore Firebox Grill Settlement to avoid the burdens and costs associated with litigating the matter any further. Those who believe they are Class Members can get a claim filed online by going to the designated settlement website and clicking the Claim Form button.
What else do I need to retain as far as the Kenmore Firebox Grill Settlement goes?
- Eligible Class Members include anyone who purchased or received (not for resale) a new Kenmore Grill with a galvanized steel firebox that was manufactured between 10/01/2011 and 09/30/2014
- Claim Forms must be completed and submitted no later than the 01/28/2018 deadline (Claim Forms can be submitted online or by mail or fax to the Kenmore Firebox Grill Settlement Administrator)
- Those who want out should be sure to send their exclusion request in writing and post-marked no later than the 03/13/2017 deadline (must include name, address, telephone number, and signature)
The Kenmore Grill model numbers included in the Kenmore Firebox Grill Settlement are: 01566, 03495, 16142, 16154, 23673, 23676, 23681, 23682, 23683, 23766, 34172, 34176, 34178, 34308, and 34611. Class Members who feel like grabbing a share of the spotlight by speaking at the Final Approval Hearing must file a Notice of Intention to Appear by 03/13/2017.
