When consumers suspect that a cheaper generic version of a certain product has been unlawfully kept from the market the words “antitrust litigation” can’t help but come to mind.  A recent example of a legal action filed over similar allegations is the In Re Aggrenox Antitrust Litigation.  The suit originates from claims that the Defendants (Boehringer Ingelheim and Teva Pharmaceutical) delayed the availability of a generic version of a medication called Aggrenox by unlawfully settling lawsuits in which the patents covering the medication were disputed.  However, it cannot go without being made clear that the Defendants deny the claims brought forth in the action and assert they did NOT violate antitrust or consumer protection laws by settling the patent lawsuits.  Regardless of who’s right and who’s wrong it appears the dispute may be coming to an end as both parties have agreed to settle the matter for a jaw-dropping $54 MILLION.  Those who believe they qualify for a taste of the cake can begin by going to the settlement page to learn more.

A Closer Look at the In Re Aggrenox Antitrust Litigation

  • The settlement is broken into two separate classes:  Consumer Class and TPP Class
  • Only purchases made in certain U.S. states are eligible to be claimed for the settlement
  • The deadline by which claim forms must be submitted is set for September 14th, 2018
  • Those who plan to make an objection or request exclusion must do so by May 11th, 2018
  • July 19th, 2018 can be circled on the calendar as the day of the Final Approval Hearing
