Box Gift Card Settlement

Gift cards can be a convenient present for both the gift giver and gift receiver.  However, the handy little items aren’t without their fair share of controversies.  One of the latest controversies regarding the issuance of gift cards is currently on display by news of the recent settlement of the class action lawsuit entitled Byerson v. FabFitFun, Inc., et al.  The lawsuit was filed over allegations that the Defendant (FabFitFun, Inc.) violated certain state laws by selling, and causing to be distributed, various gift cards with allegedly unlawful expiration dates.  It should be pointed out that the Defendant denies these allegations and contends that the settlement is only agreed to in order to avoid the expense of going deeper into litigation.  Those who believe they are eligible to receive compensation can begin the filing process by going to the Box Gift Card Settlement page and clicking the Submit Claim tab.

  • Gift cards must have been received between January 1st, 2013 and April 11th, 2017
  • Claim forms, objections, and exclusion requests must be filed by October 6th, 2017
  • A hearing regarding final approval of the settlement is set for October 26th, 2017
  • Those who do nothing at all will receive no compensation a lose the right to sue
  • Attorneys’ fees of $147,500 will include costs, expenses, and Plaintiff’s incentive
